The South Dakota Legislature created the Authority in 2005 to diversify and expand the state's economy by developing energy production facilities and the energy transmission facilities necessary to produce and transport energy to markets within the state and outside the state. The Authority is codified in the South Dakota Codified Laws Chapter 1-16I (SDCL 1-16I). Specifically, the SDEIA must meet with any interested owner of transmission lines in South Dakota and any interested generator and distributor of electricity by August of each year. The Authority then reports its findings and makes recommendations about what the private sector, state and federal government can do to create and enhance the generation of electricity in South Dakota.
