We take on a relatively small number of clients, and strive to do a superior job on those cases. A natural consequence of such an approach is that the firm limits itself to cases involving significant issues and the potential for large recoveries. Each case undertaken benefits from the attention of the firm's collective judgment. Although each case is assigned to one or two attorneys, the considerable experience of the entire firm is brought to bear on every case. The firm approaches and prepares each case as though it will proceed to trial. This preparation, together with the firm's acknowledged ability in trial, allows it to settle the vast majority of cases at substantial levels. If, however, the case cannot be settled to the advantage of the client, the firm is well-prepared and ready to go to trial to seek the best results for each client. It is the goal of the firm to provide representation equal to that available anywhere, regardless of a client's financial circumstances. As a result, much of the work of the firm is done on a contingent fee basis. In a contingent fee case we are paid a percentage of the recovery when and if that happens. If the client is not in a financial position to pay out of pocket "costs" (including such things as investigation fees, deposition expenses, filing fees, expert witness fees, etc) as the case goes along, then we pay those costs as they are incurred, and we are reimbursed from the recovery or recoveries obtained. That occurs more often than not, since it is not unusual for the costs involved in pursuing a lawsuit to be very substantial. And, in Colorado, if a suit is unsuccessful and results in no recovery, a client need not be obligated to repay the costs advanced by the attorney if doing so would be a substantial financial hardship. In short, the contingent fee approach allows a client to seek what he or she is entitled to and deserves under the law, regardless of limited financial resources.
